1. Terms of Service & User Agreement

1.1 The Service. "LiveFans" — also referred to as "The Director's Suite" — is an automated video processing and direct-message generation platform. By using the Service, you grant us a non-exclusive, royalty-free, worldwide license to access, record, and edit your public broadcast for the sole purpose of creating video clips ("Trophies") for your use and distribution.

1.2 The Watermark. You acknowledge that the Service may be provided under a pricing model that includes an optional or mandatory watermark (Liveroom.cc/models) on generated content. You agree not to obscure, crop, or remove the watermark where it is marked mandatory. Attempting to remove a mandatory watermark is a violation of these Terms and may result in immediate termination of service without refund.

1.3 The Guarantee. If a Setup Fee was paid, you are eligible for a full refund if the Service fails to meet your expectations within the first 30 days of active use. Refund requests must be submitted via in-app support.

2. Consent to Record & Model Release

2.1 Authorization. I, the undersigned Model, hereby authorize the Service to automatically record my public live stream on Chaturbate and to ingest clips I upload directly. I understand these recordings are processed into short video clips and stored on a private server for my review.

2.2 Distribution Rights. I retain full ownership of my performance. I grant the Service the right to deliver these specific video clips to third-party users (my "Fans") via direct message or download link, only upon my explicit approval in the Dashboard.

2.3 Likeness Release. I release the Service from any liability concerning the capture of my likeness, voice, and performance, provided the content is used strictly in accordance with these Terms.

3. Age Verification & 2257 Compliance

3.1 Age Warranty. I certify under penalty of perjury that I am at least eighteen (18) years of age.

3.2 18 U.S.C. § 2257 Disclosure. I verify that I am the "primary producer" of the original live content as defined by 18 U.S.C. § 2257. The Service acts solely as a "secondary producer" or technical processor. I confirm that my age verification records are currently on file with the primary hosting platform (Chaturbate) and are available for inspection as required by federal law.

3.3 Prohibited Content. I agree not to use the Service to record or distribute any content involving minors, non-consensual activities, or any other illegal material. The Service reserves the right to report such content to relevant authorities.

4. Eligibility & Account

• You must be at least 18 years old and have the legal capacity to enter into binding contracts.
• You may not be prohibited from using the Service under applicable laws of your jurisdiction.
• You must provide accurate, current registration information.
• You are responsible for maintaining account security and for all activity under your account.
• You must notify us immediately of any unauthorized access.

5. Pricing, Packs & Refunds

5.1 Setup Fee

LiveFans charges a one-time setup fee at signup. There is no recurring subscription. After setup, you purchase video packs as needed.

5.2 Video Packs

• Packs are sold in tiers (e.g. 5 / 10 / 15 video credits).
• 1 video credit = 1 full pipeline run with unlimited personalised DMs across Telegram and Chaturbate.
• Video credits never expire.
• All fees are in USD unless otherwise stated and are processed securely through Stripe.

5.3 Cancellation & Refunds

• You may cancel your account at any time from your account settings. There is nothing recurring to cancel.
• Setup-fee refunds are governed by Section 1.3 (the 30-day guarantee).
• Used video credits are non-refundable. Unused credits are refundable on request within 30 days of purchase.
• Refund requests are processed via in-app support, typically within 48 hours.

6. Acceptable Use

You agree NOT to:

• Violate any laws or regulations.
• Infringe on intellectual property rights.
• Transmit harmful code (viruses, malware, etc.).
• Attempt to gain unauthorized access to systems or other users' data.
• Use the Service for spam, unsolicited bulk messaging outside of your own opted-in fan base, or to message individuals who have not chosen to receive contact from you.
• Harass, abuse, or harm others, or impersonate any person or entity.
• Resell or redistribute the Service.

7. Content & Intellectual Property

7.1 Your Content

You retain ownership of content you upload or that the Service records on your behalf. You grant LiveFans a license to store, process, transcode, and display your content solely as necessary to provide the Service.

7.2 Our Intellectual Property

The Service — including all software, designs, text, graphics, and trademarks — is owned by LiveFans and protected by intellectual property laws. You may not copy, modify, or distribute our intellectual property without permission.

8. Affiliate Commission Disclosure

8.1 Material Connection. You acknowledge that any watermark (Liveroom.cc/models) embedded in your videos is an affiliate link. The provider of this Service may earn a financial commission for traffic or new model sign-ups generated through this link.

8.2 Mutual Benefit. Affiliate revenue subsidizes the cost of the video processing servers, allowing us to offer the Service at a reduced or founders rate to you.

9. Third-Party Integrations

The Service integrates with third-party platforms (Telegram, Chaturbate, Stripe, OpenAI/Anthropic/Google language models). Your use of these integrations is subject to their respective terms and privacy policies. We are not responsible for third-party services.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE UNINTERRUPTED, SECURE, OR ERROR-FREE SERVICE, NOR DO WE GUARANTEE ANY SPECIFIC LEVEL OF REVENUE, FAN ENGAGEMENT, OR CONVERSION OUTCOME.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LIVEFANS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR OTHER INTANGIBLE LOSSES.

12. Indemnification

You agree to indemnify and hold harmless LiveFans from any claims, damages, or expenses arising from your use of the Service, your content, or your violation of these Terms.

13. Termination

We may suspend or terminate your account if you:

• Violate these Terms.
• Engage in fraudulent activity.
• Fail to pay applicable fees.
• Engage in prohibited conduct under Section 6.

Upon termination, your right to use the Service ceases immediately. We may delete your data in accordance with our Privacy Policy.

14. Modifications

We reserve the right to modify these Terms at any time. Material changes will be notified via in-app support or email. Continued use after changes constitutes acceptance.

15. Governing Law

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Alberta.
